POCSO On The Ground. Round 2.

On 11th May 2015, the first POCSO on the Ground (POTG) – an evidence based examination of the implementation of Protection of Children from Sexual Offences Act 2012 was held. The platform brought together a group consisting of social workers, child rights activists, lawyers, doctors, counselors and other members from civil society from across sectors and geographies. In the ensuing deliberation, several issues and challenges around the new law were identified.

By common consensus, the group identified 3 issues that needed to be worked on in depth 1) Mandatory Reporting & Age of Consent 2) Uniformity in Health Systems and 3) Rehabilitation of a Child Victim of Sexual Offences. Voluntary working groups were formed around each issue.

Between June and October 2015, every working group met and deliberated on these specific issues amongst themselves. On 30th October, 2015, the second round of POTG was called so the groups could share their reflection and deliberation within the groups and other interested stakeholders. The objective was to present and assess the progress made, consider suggestions and opinions of peers and chart the way forward.

The meeting was commenced by Ms. Priti Patkar, Founder, Prerana. She introduced the POTG initiative and the working groups.

She mentioned that even as Prerana, under its Aarambh initiative was most willing to facilitate and anchor the meetings and consultations around POCSO, the ownership of content and material generated by the groups would be collective and common.

Ms. Alpa Vora, Child Protection Specialist, UNICEF mentioned that the group will also consensually decide how the material needs to packaged and strategized towards larger advocacy and policy change.

Mandatory Reporting

Advocate Maharukh Adenwalla presented the deliberations by the working group on Mandatory Reporting. (The group is supposed to be looking at Mandatory Reporting and Age of Consent. However, for Round 2 of POTG they decided to focus only on Mandatory Reporting).

Before presenting, Adv. Adenwalla clarified that the document was still a ‘work-in-progress’. She mentioned that given the complexities and vagaries of the issue, the journey towards clarity will bean enlightening one but a concrete conclusion to the process may prove elusive.

Uniformity in Health Systems

Aarthi Chandrashekar, Research Officer at CEHAT presented the discussions by the group working on ‘Uniformity in Health Systems.’

A key incident had transpired in the last few months: On 7th August 2015, a Government Resolution was passed stating that the Guidelines and Protocol to respond to Survivors/Victims of Sexual Assault by the Ministry of Health and Family Welfare is to be followed in the State of Maharashtra. Hence a fundamental and longstanding issue regarding bringing Uniformity in Health Systems and Protocol was addressed.

Rehabilitation

Pooja Kandula, research officer of Prerana’s Aarambh initiative presented the activities and discussions of the working group on Rehabilitation. Ms. Patkar of Prerana facilitated the post-presentation discussions.

The working group’s approach brings a unique angle to the issue in that it aims to interpret and expand the scope of POCSO so that it not just addresses justice by punishing the offenders but also, holistically, from the point of view of rehabilitation of the child victim

The Way Forward:

The groups will take back the discussions and learning from Round 2 of POTG and meet again amongst themselves. The deliberations will continue as per schedule.

The checklists, documents, tool kits etc. will be circulated amongst the group and feedback will be collected. After fine tuning the documents, they will be presented to the relevant stakeholders (CWC/Police etc.) for use and implementation.

The working groups will begin to start planning on how to put together the material generated towards larger advocacy.

Round 3 of the POTG will be held sometime in January/February 2015 where the groups will share their final presentations.
